End User License For Digital Content
This End User License For Digital Content is effective as of 26th March 2025
Please carefully read this Agreement prior to making a purchase on our web-site. Be aware, that this Agreement constitutes a binding legal agreement between you and PocketBook, as a publisher`s agent. Before making purchase and receiving access to the digital content, you must agree to be bound by the terms of this document. If you refuse to be bound by this Agreement, you must refrain from making a purchase on our web-site.
We may at any time modify this Agreement and other applicable terms, conditions, and conditions of use, in whole or in part, for example, for the following reasons: for legal or regulatory reasons, for security reasons, to further develop, enhance or add to the existing features of our services, to make technical adjustments and to ensure the future functionality of our Services. If we make any changes, we will notify you within a reasonable period of time and inform you of the rights to which you are entitled. You must agree to be bound by the amended/updated Agreement to continue using the Digital content. If a change proves to be invalid, void, or unenforceable for any other reason, the validity and enforceability of the remaining changes or conditions shall not be affected.
License
By purchasing digital products, such as eBooks (here and after referred to as the “Digital Content” and/or “eBook”), you are acquiring from the publisher a license to use the Digital Content in accordance with the terms and conditions of this Agreement. By downloading Digital content you agree to use it solely as provided in this Agreement and to comply with all of the terms and conditions of this Agreement.
Digital content is protected by copyright. Through purchase, You are granted with a non-exclusive, non-assignable, non-sublicensable, non-transferable, revokable right (here and after referred to as the “License”) to view, download, use, and display Digital content an unlimited number of times, solely on up to five (5) Transfer Devices and five (5) Non-Transfer Devices at the same time, and solely for your personal, non-commercial, domestic, non-institutional, non-corporate and non-teaching use and not for lending as well. Further License restrictions result from the following provisions and, if applicable, from the respective offer pages.
"Non-Transfer Device" is a device (including, without limitation, a digital content rendering device or mobile phone) that cannot transfer a Digital content to any other device, except if that other device is already authorised by us to acquire that Digital content. A "Transfer Device" shall be defined as being a computer that can transfer the Digital content to any other device.
You may re-download previously purchased eBooks through "My account --> Books and other contents".
We DO NOT guarantee that our digital content is fit for a particular purpose. We DO NOT know and DO NOT collect any data from you regarding the particular purpose for which you are contracting for our digital content.
eBook Titles
The content of each eBook Title is a copyrighted work of publisher indicated in the eBook Title and publisher reserves all rights in and to each eBook Title.
You are receiving only a limited right from publisher to use each eBook Title for your own internal or personal use. You may not reproduce, forward, modify, print, create derivative works based upon, transmit, distribute, disseminate, sell, publish or sublicense any eBook Title or in any way commingle the content of any eBook Title with other third party content, without publisher's prior written consent.
Copyright
You acknowledge that all copyright, patent, trademark, database rights and all other intellectual property rights in or relating to the Digital content are the sole property of Pocketbook or its licensors and that this Agreement does not in any way give rise to any right title or interest in the Digital content except as described. All rights not expressly granted to you under this Agreement are reserved for and by Pocketbook and its licensors.
Restrictions
You are NOT permitted:
- to change or edit the Digital content in any way or to use modified versions, to make them publicly accessible or to make them available to third parties in any other way, whether for a fee or free of charge, or to use them for commercial purposes. In each case, any usage possibilities resulting from mandatory legal regulations in favor of the customer remain unrestricted;
- to sell, resell, or sub-license the Digital content, in whole or in part;
- remove, obscure or alter copyright notices, acknowledgements or other means of identification, or disclaimers.
Your failure to comply with this Agreement and/or with the author instructions, may result in the access restriction to Digital content.
Digital content can be individually marked with digital watermarks so that the original buyer can be identified and tracked in the event of misuse. Digital content can also be protected against illegal copying by Adobe Digital Rights Management (DRM) protection. The use of this digital content is only possible via the respective Adobe ID stored on the customer's terminal device.
Disclaimers
ALL DIGITAL CONTENT, INCLUDING WITHOUT LIMITATION EBOOK TITLES, ARE PROVIDED ON AN "AS IS" BASIS. NEITHER POCKETBOOK, NOR PUBLISHER AND ITS LICENSORS MAKE ANY GUARANTEES OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE AS TO ANY PUBLISHER CONTENT OR THE INFORMATION THEREIN OR ANY WARRANTIES AS TO THE ACCURACY, COMPLETENESS, CURRENTNESS, OR RESULTS TO BE OBTAINED FROM, ACCESSING OR USING PUBLISHER’S CONTENT, OR ANY MATERIAL REFERENCED IN SUCH CONTENT. ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, ARE DISCLAIMED. ANY MATERIAL OR DATA OBTAINED
USE OF DIGITAL CONTENT IS AT YOUR OWN DISCRETION AND RISK AND YOU UNDERSTANDS THAT IT WILL BE SOLELY RESPONSIBLE FOR ANY RESULTING DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA.
NEITHER POCKETBOOK, NOR PUBLISHER AND ITS LICENSORS SHALL BE LIABLE TO ANY USER OR TO ANYONE ELSE FOR ANY INACCURACY, DELAY, INTERRUPTION IN SERVICE, ERROR OR OMISSION, REGARDLESS OF CAUSE, OR FOR ANY DAMAGES RESULTING THEREFROM.
IN NO EVENT WILL POCKETBOOK OR PUBLISHER OR ITS LICENSORS, BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOST TIME, LOST MONEY, LOST PROFITS OR GOOD WILL, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SUCH DAMAGES ARE FORESEEN OR UNFORESEEN WITH RESPECT TO ANY USE OF PUBLISHER CONTENT.
Delays
Neither party shall be responsible for delay or failure in performance resulting from acts beyond the control of such a party, including but not limited to, an act of God; an act of war, riot, epidemic, fire, flood, other disasters; or an act of government.
Term and Termination
You are granted with the unlimited in time license, that is why this Agreement is concluded for an indefinite period of time.
Meanwhile, Pocketbook may terminate this Agreement immediately in case of your failure to comply with the terms of this Agreement. You will be notified via your email about such a termination.
Upon termination of this Agreement, publisher will remove your access to the Digital content.
Applicable Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
Jurisdiction
We encourage You to resolve in an amicable manner all disagreements and misunderstandings (a “Dispute”) connected with this Agreement. In case of failure to reach the amicable solution the dispute shall be transferred to the courts of England.
Other Provisions
Should any provision of this Agreement be held to be void, invalid or inoperative, the remaining provisions of this Agreement shall not be affected and shall continue in effect and the invalid provision shall be deemed modified to the least degree necessary to remedy such invalidity.
